Terms of Service - User Agreement & Policies

Please read these Terms of Service ("Terms") carefully before using the touristesim.net website and purchasing our eSIM services. By accessing or using our service, you agree to be bound by these Terms.

1. Description of Service

Tourist eSIM provides travel-related cellular data plans via eSIM (Embedded SIM) technology. We act as an intermediary between the user and various global telecommunications networks to provide mobile data connectivity.

We may also provide virtual number services where explicitly offered. Virtual numbers are SMS-reception products and do not include voice calling or mobile data unless clearly stated otherwise.

2. Eligibility & Device Compatibility

Device Compatibility: It is the sole responsibility of the user to ensure their device is eSIM-compatible and carrier-unlocked. Tourist eSIM is not liable for purchases made for devices that do not support eSIM technology.
Registration: Some jurisdictions require identity verification (KYC). You agree to provide accurate identification if requested to comply with local laws.

3. Purchase and Activation

Delivery: Upon successful payment, an eSIM profile (usually in the form of a QR code) will be delivered to the email address provided.
Activation: The validity period of the data plan typically begins either upon installation or when the eSIM connects to a supported network. Please refer to the specific plan details at the time of purchase.
Expiration: Each eSIM has a predefined data limit and validity period. Once the period ends or data is exhausted, the eSIM will cease to function unless topped up (where available).

4. Refund & Cancellation Policy

Due to the digital nature of the product, our refund policy is as follows:

Non-Refundable: Once the eSIM QR code has been delivered and/or scanned/installed, the order is generally non-refundable.
Technical Issues: Refunds may be considered if a technical failure on our side or the network provider's side prevents service, provided the user contacted our support team during the event to troubleshoot.
Compatibility Errors: We do not offer refunds if your device is locked to a specific carrier or does not support eSIM.

5. Acceptable Use

You agree to use the service for lawful purposes only. You are prohibited from:

Using the service for any fraudulent or illegal activities.
Reselling or redistributing the data service without prior written authorization.
Engaging in activities that may damage or interfere with the network infrastructure.

6. Virtual Number Terms

Third-Party App Dependency: Verification success on third-party platforms (e.g., WhatsApp, social apps, banks, delivery apps) depends on each platform's own rules and is not guaranteed.
Intended Use: Virtual numbers are intended for SMS reception only unless otherwise specified in product details.
Non-Refundable Consumption: Once a virtual number is provisioned to your account, it is considered consumed under digital product rules, subject to our refund policy exceptions for non-delivery and verified provider-side technical failure.
Abuse Prevention: We may suspend access for abuse, fraud indicators, or legal/regulatory reasons without prior notice.

7. Service Availability & Limitation of Liability

Network Coverage: Service depends on the coverage and quality of our local roaming partners. We do not guarantee uninterrupted service or specific data speeds.
Limitation: Tourist eSIM shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the service. Our maximum liability is limited to the amount paid for the specific eSIM plan in question.

8. Modifications to Service and Prices

Tourist eSIM reserves the right to:

Modify or discontinue any plan or service at any time.
Change pricing for any data plan without prior notice (existing active plans will not be affected).

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Tourist eSIM is registered, without regard to its conflict of law provisions.
